General Conditions of Sale

These General Contract Conditions (GCC) govern the purchase, by electronic means, of products (items for women: bags, accessories, and clothing) available on the website www.inbags.it, managed and owned by InBags with registered office in Via Favignana, 80026 Casoria, Naples, Italy.

The GCC constitute an integral and essential part of the product purchase contract, and the submission of the order implies their acceptance by the Customer.

Acceptance of the General Conditions of Sale (GCC)

1.1 – The contract stipulated between InBags and the Customer is concluded upon the acceptance, even partial, of the order by InBags. This acceptance is considered tacit, unless otherwise communicated to the Customer. By placing an order, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions indicated.

1.2 – If the Customer is a consumer, once the online purchase procedure is concluded, they shall keep a copy of these general conditions of sale in accordance with Legislative Decree 206/05.

1.3 – Any right of the Customer to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order, is excluded.

Purchasing on the site is only permitted for adults.

It is strictly forbidden to enter false, third-party, or fictitious data in the registration procedure. InBags reserves the right to legally prosecute any violation.

These GCC may be modified by InBags without notice. Each contract will be governed by the GCC in force at the time of the order.

Purchase Method

2.1 – The Customer can only purchase the products present in the electronic catalogue of the site at the time of the order, as described in the relative information sheets. The images are for illustrative purposes and may differ in colour, dimensions, and accessories. The supporting information for the purchase is generic informational material.

2.2 – The correct receipt of the order is confirmed by an email sent to the address indicated by the Customer, including the date/time and Order Number. The Customer is responsible for verifying its correctness and promptly communicating any corrections.

2.3 – In case of non-acceptance of the order, InBags guarantees timely communication.

InBags reserves the right to change prices at any time, without notice. In the event of an incorrect and/or clearly derisory price, the order will be cancelled even if initially validated.

If a product is unavailable, InBags will contact the Customer within 10 days of the order, communicating the unavailability and any alternatives; the Customer may wait, if the product is deemed available, or cancel with a refund of any amounts already paid.

For some promotional products, InBags reserves the right to accept orders by reducing quantities, subject to prior notice and Customer acceptance; otherwise, the order will be cancelled.

Shipping occurs only when all requested products are available; partial shipments are not made.

Payment Methods

3.1 – InBags may request additional information or documents to prove ownership of the payment method; in the absence thereof, it reserves the right not to accept the order.

3.2 – Accepted Payment Methods: Payments are accepted via PayPal and Credit/Debit Card. Installment payment with Klarna is also available. The Customer can also use Apple Pay and GPay.

3.3 – InBags does not know the Customer's card details, which are transmitted over a secure connection to the payment institution. Any memorization occurs only upon explicit request and consent of the Customer, with certified security standards and masked display.

3.4 – PayPal and Credit Card: the charge is immediate upon completion of the transaction.

3.5 – Customs duties are the responsibility of the buyer.

Shipping: Methods and Costs

4.1 – An invoice is issued for each order based on the data provided by the Customer; no changes are possible after issuance.

4.2 – Delivery costs, where applicable, are borne by the Customer and clearly indicated during the ordering phase. For international shipments, a base cost of €10 is expected in addition to documentary charges as per point 4.6.

4.3 – No responsibility for processing or delivery delays.

4.4 – Delivery is to the ground floor unless otherwise indicated. Upon delivery, the Customer must verify the number of packages and the integrity of the packaging, affixing a written RESERVATION OF CONTROL in case of anomalies. Any problems with integrity/correspondence/completeness must be reported within 3 days.

4.5 – Failure to collect within 5 working days results in the return of the goods to InBags warehouses.

Preparation and Delivery Times

Order preparation times: orders with confirmed payment by 5:00 PM on a working day are entrusted to the courier within 1–3 working days, barring unforeseen circumstances. This is an indicative and non-binding period.

Courier delivery times (Italian Territory): generally 1–2 working days from collection.

Courier delivery times (Europe): generally 4–5 working days from collection (Italy times + 3 days).

Courier delivery times (Rest of the World): generally 8–9 working days from collection (Italy times + 7 days).

Shipments are made with Express Courier.

Unavailability and refunds: in case of impossibility of procurement, timely communication to the Customer; if a Consumer and delivery is beyond 30 days, refund of any advances within 30 days from the day following the order.

Force majeure: events such as strikes, authority measures, rationing, transport difficulties, fires, floods, non-attributable faults, suspend/delay the obligation. If beyond 30 days, either party may withdraw; no indemnity is due, except for the refund of amounts already paid within 14 days.

4.6 – Deliveries outside Italy: customs duties and import taxes are the responsibility of the Customer; customs policies are variable; cross-border deliveries may be inspected.

Right of Withdrawal

5.1 – The consumer has the right of withdrawal within 14 days of receipt, without penalty and without the obligation to state a reason.

5.2 – To exercise it: contact info@inbags.it or send a registered letter with return receipt to InBags Customer Service c/o InBags, Via Favignana, 80026 Casoria (NA). Return instructions provided by InBags; the goods must arrive within 10 days. Refund within 14 days of verifying integrity, retaining only shipping costs. Bank transfer (provide IBAN) or bank cheque. Products must be intact, complete, in original packaging, without signs of wear.

5.3 – Conditions: withdrawal on the entire product; customized/personalized goods are excluded; original packaging and complete equipment; shipment under the Customer's responsibility; possible deduction up to 10% for packaging restoration.

5.4 – Forfeiture of the right of withdrawal due to lack of integrity (non-diligent use, absence of original packaging/parts, non-transport damages). The goods remain at InBags available for collection at the Customer's expense.

Warranties

Products are covered by the manufacturer's conventional warranty and by the 24-month legal warranty for defects of conformity (Legislative Decree 206/05). Keep the invoice.

6.1 – 24-month warranty for defects of conformity with proper use and according to documentation; reserved for the Consumer. Restoration of conformity without costs (repair/replacement/price reduction/resolution).

6.2 – If it is impossible to return a product under warranty (repaired or replaced), refund or replacement with a product of equal or superior characteristics.

6.3 – Repair/replacement times depend on the manufacturer's policies; compensation for delays is excluded.

6.4 – Warranty returns must be in original and complete packaging; avoid labels/tapes on the packaging; indicate the RMA number on the outside of the package.

Privacy

7.1 – The personal data requested are processed to satisfy the Customer's requests. Compliance with current regulations (Legislative Decree 196/03 and subsequent amendments). Data Controller: InBags, Via Favignana, 80026 Casoria, Naples, Italy.

Applicable Law and Out-of-Court Resolution (ADR/ODR)

The purchase contract concluded on www.inbags.it is governed by Italian law. The most favourable and mandatory provisions of the user's country of habitual residence remain unaffected.

For disputes relating to the application, execution, and interpretation of the GCC, the court of the place where the user resides or has elected domicile is competent.

European ODR Platform: http://ec.europa.eu/consumers/odr/.

The consumer's right to appeal to the competent ordinary judge remains, regardless of the outcome of any out-of-court procedures.

The European Small Claims Procedure (Reg. (EC) No. 861/2007) is accessible to EU users not residing in Italy for values up to € 2,000.
